A date will be set on Friday in Peterborough's Superior Court of Justice to hear an application to dismiss drug charges against a Peterborough businessman.
Tracy Allan Robinson's lawyer has filed an application in Superior Court to have his drug charges dismissed.
Robinson, owner of Mr. Bob's Gourmet Pizza on The Queensway, was charged Oct. 15, 2007 with possession of cocaine for the purpose of trafficking, possession of ecstasy for the purpose of trafficking and possession of oxycodone for the purpose of trafficking after police searched his home and business.
Lawyer Jeff Ayotte represents Robinson and is seeking to have the charges dismissed because the case has taken too long to come to trial.
Robinson's case was scheduled to go to trial in September but the trial of Alexander Clachers, who was convicted last week, was given priority.
If Ayotte succeeds in his application, charges against Robinson would be stayed.
Ayotte has said other cases, with facts similar to Robinson's, have had successful applications based on delays of only 21 months.
Robinson was present in court Monday and said, "I'd be delighted to be here," on Friday.
